Trying the Times Square Car Bomber

Should we turn him over to the military or give him the proper civilian trial afforded all US citizens? I think he should be in civilian court. While what he did was terrorisim, he is still an American citizen. You can't just throw the constitution out the window depending on the circumstances. Well, the idiots in Washington do, but it shouldn't be done.

No he wasn't born here, but he did do what was needed to become a citizen thus I think he is intitled to to the same rights that the law allows it's citizens who have committed crimes. How this is handled can have a broader effect than just terrorisim. If we throw away his rights as a citizen, we also throw out a lot of reasons for other imigrants to come here legaly. What would be the point of going about becoming a citizen legally if we show here that that citizenship means nothing unless you were born in the US?

The current Military Commissions Act as passed by Congress does not allow a U.S. citizen to be prosecuted by military commission, despite cries by some lawmakers to have Faisal Shahzad and other alleged terrorists tried before military commissions -- and not in a federal civilian court.

A military commission is not an option for trying alleged Times Square car bomber Faisal Shahzad unless the naturalized U.S. citizen can be linked to Al Qaeda.

The current Military Commissions Act as passed by Congress does not allow a U.S. citizen to be prosecuted by a military tribunal, though some lawmakers say they would like to have Shahzad and other alleged terrorists put before military commissions -- and not tried in federal civilian court.

The Pakistani-born American accused of trying to detonate a bomb-laden SUV in New York's Times Square Saturday night was caught fleeing the U.S. Monday night when his Dubai-bound flight was returned to its gate at New York's Kennedy Airport.

Shahzad is expected to appear in court Tuesday to face charges that he tried to set off a massive fireball and kill Americans after parking his car on one of the busiest streets in the world, officials said.

Shahzad reportedly told authorities that he acted alone in the May 1 bomb attempt and said he has no links to radical groups in his native Pakistan. If true, he cannot be prosecuted by a military commission because the law allows a defendant to be tried by the military only if he or she has known ties to Al Qaeda or its direct affiliates.

Excellent post. I think that perhaps life in prison and put in general population would solve the problem.

Thank you. That's what he should get, going by the law that is. I doubt he'll get that long.

Personaly, I think if they have him dead to rights and no doubt he is the one guilty, they should send him to one of the survivalist camps up in the mountains. One that has plenty of ex military in the fold. He'd have a good ole time at the pig pickin they throw for him. Twisted Evil

The last I heard they are getting a lead on a money trail for
Shahzad. They may be able to track him back to a terrorist group.

I think here in the US we better get our act together as to how we want to hold the court hearings for suspected terrorists. It seems the Obama Administration has wanted to think these last three terrorist attacks were done by a lone person who has no connections to Islamic extremists. It seems to me the Fort Hood incident, the underwear bomber and now this latest attempted bombing in Time Square, all of these men have ties to Islamic Terrorist Groups. I am thinking military trials would be the best way to go but it seems our government cannot make a decision on this.

But then CH I also see your point that this latest man is a citizen of the US. I also wonder why if these men are being trained by these terrorists groups to do a bombing, the training seems to be very amateur and leaves one to wonder what is really going on. It all does not seem to add up. It is like they are want to be terrorists who just make a lame attempt at bombing something.

I think it's to be an annoyance. Al qaeda knows these clowns don't have the sense to pull off a bombing unless they get real lucky. But it makes for a good distraction. It's kind of like a thing I used to do in school to people I was about to get into a fight with. I'd show them my left hand and ask them if they see it, then slap the heck out of them with my right hand while they were paying attention to my weak hand.

This makes sense. They are just toying with us. But it seems to me if they really wanted to kill groups of people here in the US they could do it. I am glad they really do not want to. Maybe they really are afraid of the consequences if they did do a bunch of harm to us.

I hope not but I think you are correct. I doubt we can stop it if they really want to do something big. It only makes sense they will. It also kind of makes sense they would pick this administration. Time will tell.

Today was crazy on the news when they found a lunch box left about the same place as the SUV carrying the explosives in Time Square. Everyone is on edge. That is just what they wanted.

It is really only a matter of time. They may try a thousand times and only get the job done once. But that once may well be a big one. Sooner or later they will get a nuclear weapon and use it. Evil or Very Mad

Yes that does seem very possible. I am surprised it has not already happened.
But thank goodness it has not. When you start thinking about it happening you realize for sure it will and it is only when.

Do you think it will start a world war if it is bad enough?

In a way it seems like we are really headed into another religious type war. Along the lines of the crusades. But this time it will be more devastating and be fought all over the world with no country being left out.

I think everything is crazy.

They are stopping prayer. There are more people who do not beleive in God.
Everyone is loosing their motivation to take care of themselves. So many FAT people.
I don't know what is happening but it is not GOOD.

But yeah, you're right. Personaly I don't care if they believe in God or not. But get off my back because I do. If they get offended because they see a prayer on a McDonald's sign, they should do what Christians have done for years when they see nudity and other such things. Don't look at it, if it bothers them too much, maybe they should go to Burger king instead.

I think our biggest problem is people have let the government get their hands into way to many things that should be governed by the states, or by our own moral character over the past century.

Our government now says, do as I say not as I do. As in the new health care. We pay or else. they say they don't have to because they voted to be exempt.... Well I vote to make myself exempt also.
